1. In these terms and conditions
a. “Application Form” means the online lottery application form on the Club’s website at https://www.estuaryrotary.org.uk.
b. “The Club” means the Rotary Club of Kingsbridge Estuary.
c. “The Club Bank Account” means The Rotary Club of Kingsbridge Estuary Trust Fund Account Sort Code: 30-90-89 Account number: 38552460
d. “Draw” means any draw that takes place on one of the Draw Dates.
e. “The Draw Dates” are the last Monday in January, April, July and October.
f. “The Grant Scheme” means the Club’s Community Grant Scheme the terms of which may be found here.
g. “The Lottery” means the Club’s Community Grant Lottery to which these terms and conditions apply.
h. The Promoter of the Lottery for the purposes of the Gambling Act 2005 is Tim Patterson of Hove To 1 Eddystone Rise Galmpton Kingsbridge, TQ7 3EY
i. “Subscriber” means someone at least 16 years of age who subscribes to the Lottery by submitting an Application Form giving their surname and the last three digits of their telephone number as a reference and who pays a Subscription by banker’s standing order.
j. “Subscription” means Fifteen pounds (£15.00) for each entry in a Draw payable every three months.
k. “Total Receipts” means the sum of all Subscriptions received by the Club for entry in the Lottery during the three months ending on the last day of the month preceding the relevant Draw Date.
l. Where the context admits, the singular includes the plural and vice vera.
2. The purpose of the Lottery is to raise funds to help finance the Grant Scheme and at the same time award cash prizes to Subscribers drawn at random.
3. To be entered in a Draw
a. the person must be a Subscriber and
b. payment of the Subscribers’ Subscription in the correct amount must have been received in Club’s Bank Account during the three months ending on the last day of the month preceding the relevant Draw Date. No exception is made where an error has been made by the Subscriber’s or the Club’s bank or in the making of the standing order. The Club is not obliged to inform anyone who submits an Application Form that their standing payment has not been received.
4. The Promoter, his spouse and children are prohibited from being Subscribers and entering Draws. Other members of the Club and their families may be Subscribers and enter Draws.
5. Draws will be made every three months until notice under paragraph 11 is given to Subscribers of the date of the final Draw.
6. Before every Draw Date each valid entry into the draw will be allocated a numbered ball.
7. On every Draw Date at 12 noon at Kingsbridge Library , Ilbert Road Kingsbridge Devon TQ7 1EB an independent member of the public will be invited to draw prizes by picking numbered balls at random out of a suitable container.
8. A prize of sixty pounds (£60.00) will be awarded for every sixteen (16) entries into the Draw. If there are fewer than 16 entries in the Draw, no prize will be awarded. No additional prizes are awarded where the total number of entries is more than but not a multiple of 16.
9. Payment of prizes will be made by BACS. The Club will email each winner within 7 days of the Draw Date to ascertain their bank account details. If no reply is received within 7 days, the Club will attempt to contact the winner by telephone on the number given on their Application Form. The Club is not obliged to take any further steps to make contact with the winner. If the Club has been unable to obtain the winner’s bank account details by the day before the following Draw Date, the prize will lapse and be applied in accordance with clause 10.
10. The balance of the Total Receipts after the prizes have been paid shall be applied as follows:
a. No more than 10% of the Total Receipts shall be used to pay the costs of promoting the Lottery.
b. After any promotion costs have been paid under clause 10.a the balance shall be applied to fund the Grant Scheme.
a. the date of the final Draw. It will be each Subscriber’s responsibility to cancel their banker’s standing order;
b. any update to these Terms and Conditions.
12. All correspondence and notices are to be sent by email as follows:
a. to the Subscriber at the email address given on their Application Form or as subsequently advised by email to the Club;
b. to the Club at lottery@estuaryrotary.org.uk.
13. The Club accepts no responsibility for loss for non-delivery of emails or if the Subscriber fails to advise the club of a change of email address. Subscribers and the Club should regularly check their spam and junk folders.
14. The Club will retain the information about the Subscriber set out in their Application Form until six months has expired after the date of receipt of their last Subscription but only for use to communicate with them as regards a prize or a discrepancy in their standing order.
15. Information contained in the Application Form will be kept confidential by the Club but if the Subscriber agrees, their name may be published if they win a prize.
16. This lottery is registered in accordance with the Gambling Act 2005 with South Hams District Council under reference SHSL0307.
17. The Lottery is governed by the rules and regulations of the Gambling Commission under legislation laid down in the Gambling Act 2005. Proof may be required of the Subscriber’s age if the Promoter believes they may be under 16 years of age.
