Emily began by explaining how care‑fee means testing works and why many families are surprised by the financial thresholds. She highlighted how Life Interest Trusts in a Will can help safeguard your share of the family home for your children, while also warning against “deliberate deprivation” — giving assets away purely to avoid care fees, which councils can challenge.
Modern family structures can create unexpected legal risks. Emily outlined several ways people may unintentionally give others a claim over their estate, including:
Broken promises that someone relied on,
Contributions to property that create ownership rights,
Challenges to the validity of a Will, and
Claims of undue influence.
She emphasised the importance of clear documentation, independent legal advice, and avoiding informal arrangements that can later be disputed.
Emily explained the Inheritance (Provision for Family and Dependants) Act 1975, which allows certain people — including spouses, cohabitants, adult children, and financial dependants — to challenge a Will if they feel they have not been left “reasonable financial provision.” She outlined how courts assess these claims and shared practical steps to reduce the risk of disputes, such as writing a Letter of Wishes or documenting a family member’s financial independence.
The talk also covered the importance of Lasting Powers of Attorney (LPAs) for both financial decisions and health and welfare. Emily stressed that LPAs ensure trusted individuals can act on your behalf if you lose capacity, and she noted that even pets can be included in your planning to ensure they are cared for according to your wishes.
Emily provided a clear overview of the current Inheritance Tax allowances, which remain frozen until 2030/31, and explained how couples can pass on up to £1 million tax‑free. She also outlined the rules around tax‑free gifting, including annual allowances, small gifts, and the seven‑year rule for larger gifts.
Emily concluded by reminding us that estate planning is highly individual and that small differences in circumstances can lead to very different outcomes. With tax and care laws changing regularly, she encouraged everyone to seek professional advice to ensure their wishes are properly protected.
